1. Who we are
Performa is a personal training business operated by Guilherme Mello, a CanFitPRO certified Personal Training Specialist serving Kitchener-Waterloo-Cambridge, Ontario, Canada. In this policy, “Performa”, “we” and “us” refer to Performa and Guilherme Mello. We handle personal information in line with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).
2. What we collect
Website visitors: This website does not have user accounts or contact forms. When you visit, our hosting provider and the analytics and advertising tools described in section 3 may automatically collect technical information such as your IP address, browser, device type, the pages you visit and how you interact with the site.
When you contact us: your name, phone or WhatsApp number, email address and the content of your messages.
When you become a client: information you choose to share with us, such as your PAR-Q+ health screening answers, medical clearance details, goals, training history, height and weight, movement and posture assessment results, lifestyle habit scores, training progress and attendance.
Payments: when you pay by Interac e-Transfer, we see your name, email and the amount. We do not collect or store credit card or banking details.
3. Cookies, analytics and advertising
This website uses Google Analytics to understand how visitors use the site, and the Meta Pixel to measure the performance of our ads and to show relevant ads on Facebook and Instagram. These tools use cookies and similar technologies to collect information such as your IP address, device and browser details, the pages you view and the actions you take on the site. We do not use these tools to collect your health information. Google and Meta process this information under their own privacy policies, and it may be stored outside Canada.
You can limit or opt out of this tracking at any time:
- change your browser’s cookie settings;
- install Google’s Analytics opt-out browser add-on;
- adjust your ad preferences in your Facebook and Instagram settings;
- or opt out of interest-based advertising through the Digital Advertising Alliance of Canada (youradchoices.ca).
4. How we use your information
We use your information to respond to your inquiries and book your free interview; to assess your readiness to exercise and keep your training safe; to design, deliver and adjust your personalized program; to communicate with you about sessions and progress; to manage scheduling and billing; to understand and improve our website and advertising; and to meet our legal and insurance obligations. We do not sell your personal information, and we do not use your health information for marketing.
5. Your consent
We collect, use and share your personal information with your consent. Because health information is sensitive, we collect it only with your express consent before training begins. You can withdraw your consent at any time by contacting us. Please note that we may not be able to train you safely without certain health information. You can opt out of website analytics and advertising cookies at any time, as described in section 3.
6. Who we share it with
We use trusted service providers to run our business, including the Everfit training app, WhatsApp, Google services (email, document storage and analytics), Meta (advertising), our website host and your bank for Interac e-Transfer. We may also use software tools, including AI-assisted tools, to help prepare training documents. These tools are used under Guilherme's professional supervision, and every program is reviewed by Guilherme before it reaches you.
These providers may store or process information outside Canada, including in the United States, where it may be subject to local laws. We share only what is needed to provide the service. We do not share your information with anyone else unless you ask us to (for example, your physician or physiotherapist), the law requires it, or there is an emergency affecting someone's safety.
7. Testimonials and photos
We publish a client's name, testimonial, photo or video only with their written consent. You can withdraw consent for future use at any time.
8. How long we keep it and how we protect it
We keep client records only as long as needed to provide our services and meet legal and professional requirements, then we securely delete or de-identify them. We use reasonable safeguards, such as password-protected accounts and limited access, but no system is completely secure.
9. Your rights
You can ask to see the personal information we hold about you, ask us to correct it, or ask us to delete it, subject to legal and professional record-keeping requirements. We aim to respond within 30 days. If you are not satisfied with how we handled your information, you can contact the Office of the Privacy Commissioner of Canada (www.priv.gc.ca).
10. Minors
Clients under 18 may train with us only with the written consent of a parent or legal guardian, and we collect and share their information through that parent or guardian.
11. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top shows the most recent version.
